Australian Unions have welcomed an important ruling from the International Court of Justice affirming the right to strike for workers worldwide and have renewed the call to reform Australia’s unbalanced protected industrial action laws.
The Court published a legal opinion confirming workers’ right to strike is protected by the International Labour Organisation’s (ILO) Convention 87 (Freedom of Association and Protection of the Right to Organise Convention).
The decision comes after employer organisations led by the International Organisation of Employers (IOE), including the Australian Chamber of Commerce and Industry (ACCI), had argued no such right exists in international law.
