An IEU member’s WorkCover (workers’ compensation) claim for psychological injury has been accepted on review with our union’s support.
WorkCover initially rejected the member’s claim, finding it arose out of “reasonable management action” which is excluded from the definition of injury under the Workers’ Compensation and Rehabilitation Act 2003.
Our union seeks review
After the initial decision was handed down, our union sought a regulator review on the member’s behalf.
Our union argued the management action was not reasonable and, on that basis, the original decision should be overturned and the member’s claim be accepted.
